Terms of Service

1) Acceptance of Terms
By creating an account on Rentisphere ("the Service"), you agree to these Terms of Service. If you use the Service on behalf of a company or legal entity, you confirm you have authority to bind that entity.
2) Description of Service
Rentisphere provides a cloud-based property management dashboard for landlords to manage properties, track tenancies, and facilitate rent collection. Rentisphere is not a landlord, tenant, or property manager and is not a party to any lease agreement created or stored on the platform.
3) Payment Processing (GoCardless)
- Third-Party Provider: Payments are processed by GoCardless. Use of this feature is subject to the GoCardless Merchant Agreement.
- No Financial Custody: Rentisphere does not receive, hold, or transfer funds. We provide the technical link between your GoCardless account and your Rentisphere dashboard.
- Liability for Failures: Rentisphere is not responsible for failed transactions, chargebacks, or bank settlement delays.
4) Security Deposits
- No Deposit Handling: Rentisphere does not process, hold, or manage security deposit funds.
- Compliance: Landlords are solely responsible for complying with applicable laws on deposit handling (e.g., escrow, interest payments, return timelines).
5) Landlord Responsibilities & Legal Compliance
- Accuracy of Records: You must ensure rent ledgers and payment statuses are accurate before taking legal action (e.g., issuing an eviction notice).
- Local Laws: You must comply with all rental laws, including Fair Housing and habitability standards.
- Tenant Privacy: Handle tenant data per our Privacy Policy and applicable data protection laws (including GDPR/CCPA).
6) Data Protection & GDPR
- Roles: Landlords are Data Controllers of tenant personal data; Rentisphere is the Data Processor.
- Processing Agreement: Use of the Service constitutes agreement to the Data Processing Addendum (DPA) attached or linked to these terms.
- Processor Commitments:
- Process data only on your instructions to provide dashboard services.
- Ensure all staff with access are bound by confidentiality.
- Maintain state-of-the-art technical security (e.g., encryption, firewalls).
- Assist with GDPR Data Subject Requests (e.g., subject access requests).
- Notify you of changes to sub-processors used for hosting or processing (e.g., AWS or Google Cloud).
7) Limitation of Liability
To the maximum extent permitted by law, Rentisphere is not liable for:
- Disputes between landlords and tenants.
- Errors in rent calculations or payment status that lead to disputes or wrongful evictions.
- Data loss or unauthorized access resulting from weak account security.
- Any indirect, incidental, or consequential damages arising from use of the Service.
8) Intellectual Property
Rentisphere owns all rights, titles, and interests in the Service, including software, design, and branding. You are granted a limited, non-exclusive license to use the Service for property management.
9) Termination
We may suspend or terminate your account for violations of these terms, non-payment, or illegal use. Upon termination, you will have 30 days to export your data before deletion.
